Welcome to Restaurant Brand Grader (the "Service"), operated by KLMG-US LLC, doing business as Restaurant Brand Builders ("RBB," "we," "us," or "our"), based in Houston, Texas. By accessing or using the Service at any domain where it is offered, you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Service.
1. What the Service Is
Restaurant Brand Grader is a free diagnostic tool that evaluates the publicly visible marketing and brand presence of restaurants. It produces a Restaurant Brand Advantage Score, a letter grade, checkpoint scores, and written recommendations (together, a "Report").
2. The Nature of Scores and Reports
This section is important. By using the Service you acknowledge and agree that:
- a. Reports are opinions, not statements of fact. Scores, grades, evidence notes, and recommendations are automated assessments and expressions of opinion generated from publicly available data and published industry standards (such as Google's business profile guidelines and Core Web Vitals thresholds), applying our proprietary evaluation framework.
- b. Reports reflect a moment in time. A Report reflects the data our systems could access at the time of the scan. Online information changes constantly, and a Report may not reflect current conditions.
- c. Data may be incomplete or unavailable. Some data sources may be unavailable, incomplete, or inaccessible at scan time. Where a website blocks automated review through security tooling, affected checks are marked unverified and are excluded from scoring rather than penalized. We never grade a business based on which vendor, platform, or agency built its website.
- d. AI-generated content. Portions of each Report are generated using artificial intelligence. AI-judged checks are evidence-backed but may contain errors, and are clearly distinguished in our methodology.
- e. No guarantees. Reports are provided for general informational purposes only. We make no representation that following any recommendation will produce any particular business result, ranking, revenue, or outcome.
- f. Not professional advice. Reports do not constitute legal, financial, accounting, or other professional advice.
3. Eligibility and Acceptable Use
You must be at least 18 years old to use the Service. You agree that you will not:
- Use the Service to scan a business for the purpose of harassment, defamation, or unfair competitive practices;
- Scrape, harvest, crawl, or bulk-download Reports, scores, or any data from the Service by automated means;
- Circumvent, disable, or interfere with rate limits, security features, or access controls;
- Misrepresent your identity or submit false contact information;
- Reverse engineer, copy, or create derivative works of the Service, the scoring methodology, or the Restaurant Brand Advantage Score framework;
- Resell, white-label, or commercially redistribute Reports without our prior written agreement;
- Use the Service in violation of any applicable law.
We may suspend or terminate access for violations of these Terms at our discretion.
4. Scanning Businesses You Do Not Own
The Service evaluates publicly available information. You may run a scan on a restaurant you do not own (for example, to evaluate a business you are considering buying, partnering with, or competing against). If you do, you agree that you will not present the resulting Report as authorized, commissioned, or endorsed by that business, and you remain responsible for your use of the Report.
5. Your Content and Contact Information
When you submit your name, email address, or phone number to unlock a Report, you represent that the information is accurate and belongs to you. You agree that we may use it as described in our Privacy Policy, including delivering your Report and, where you have consented, sending you marketing communications from Restaurant Brand Builders. You may opt out of marketing at any time.
6. Intellectual Property
The Service, including the Restaurant Brand Grader name and logo, the Restaurant Brand Advantage Score name and scoring framework, the This Is Branding framework, the MARKETING IS and BRANDING IS checkpoint structures, all site design, copy, and software, is owned by KLMG-US LLC or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable license to use the Service and to use, download, and share your own Report for your internal business purposes. No other rights are granted.
Third-party data displayed in Reports, including business information, ratings, and review content, originates from third-party sources such as Google and remains subject to those parties' rights and terms.
7. Third-Party Services and Links
The Service relies on third-party data providers and infrastructure (including Google Places, Google PageSpeed Insights, and AI model providers) and may link to third-party websites, including booking and scheduling tools. We are not responsible for third-party services, their availability, or their content.
8. Service Availability
The Service is provided free of charge and on an "as available" basis. We may modify, suspend, or discontinue the Service, or any feature of it, at any time without notice. We may impose or change usage limits, including scan limits, at any time.
9. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SCORES OR REPORTS ARE ERROR-FREE, CURRENT, OR COMPLETE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR SECURE.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KLMG-US LLC, ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO THE SERVICE OR ANY REPORT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Indemnification
You agree to indemnify and hold harmless KLMG-US LLC and its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction and venue there. YOU AND KLMG-US LLC EACH WAIVE ANY RIGHT TO A JURY TRIAL AND AGREE THAT ANY CLAIM MUST BE BROUGHT INDIVIDUALLY AND NOT AS PART OF A CLASS OR REPRESENTATIVE ACTION.
13. Corrections and Takedown Requests
If you are an owner or authorized representative of a business that has been scanned and you believe a Report contains a material factual error in the underlying data, or you wish to request that a Report be removed, contact us at the email below. We will review reasonable requests in good faith.
14. Changes to These Terms
We may update these Terms from time to time. The effective date above reflects the latest version. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
